Terms of Service

These Terms of Use ("Terms") govern your access to and use of The Creator, an AI-powered content development application owned, operated, and managed by The Creator (Empowered by BizTomate Inc) ("we," "our," or "us").

These Terms are entered into between you and The Creator (Empowered by BizTomate Inc). By downloading, accessing, or using Creator, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use Creator.

1. Ownership

Creator is owned and operated by The Creator (Empowered by BizTomate Inc). All software, branding, systems, designs, intellectual property, and related services remain the exclusive property of The Creator (Empowered by BizTomate Inc). Nothing in these Terms transfers ownership rights to you.

2. Service Description

Creator provides AI-powered tools that may include:

• Content creation and editing assistance
• Idea generation and creative planning
• AI-assisted writing and media support
• Productivity and workflow automation features

Features may be added, modified, or discontinued over time as the product evolves.

3. User Responsibilities

You agree not to:

• Upload unlawful, harmful, or infringing content
• Violate intellectual property or privacy rights of others
• Distribute malware or attempt to compromise Creator systems
• Abuse, overload, or misuse AI systems or platform resources
• Harass, threaten, or harm other users or third parties
• Reverse engineer, decompile, or attempt to extract source code

4. User Content Responsibility

You remain solely responsible for all content you upload, create, publish, or generate using Creator.

The Creator (Empowered by BizTomate Inc) does not guarantee the accuracy, completeness, suitability, or legal compliance of AI-generated outputs.

You must independently review, verify, and approve all generated content before use in business, marketing, legal, financial, or public communications.

5. Subscription Services

Creator may offer paid plans, including monthly or annual subscriptions and premium AI access.

Subscriptions renew automatically unless cancelled through your app store account or applicable billing settings before the renewal date. Refund policies may be subject to the platform through which you purchased (e.g., Apple App Store or Google Play).

6. Suspension & Termination

The Creator (Empowered by BizTomate Inc) may suspend or terminate access to Creator if we reasonably believe there is abuse, fraud, security threats, or violations of these Terms or applicable law.

You may stop using Creator and request account closure at any time.

7. Limitation of Liability

Creator and related services are provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, The Creator (Empowered by BizTomate Inc) is not liable for:

• Lost revenue or profits
• Business interruption or operational delays
• Data loss or corruption
• Errors or inaccuracies in AI-generated content
• Indirect, incidental, or consequential damages

8. Indemnification

You agree to indemnify and hold harmless The Creator (Empowered by BizTomate Inc), its officers, directors, employees, and affiliates from claims, damages, losses, and expenses arising from your content, your use of Creator, or your violation of these Terms or applicable law.

9. Governing Law

These Terms are governed by the laws of Canada, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of courts in Canada, unless otherwise required by law.

10. Changes to These Terms

The Creator (Empowered by BizTomate Inc) may update these Terms from time to time. We will post the updated version and revise the effective date. Continued use of Creator after changes become effective constitutes acceptance of the revised Terms.
